Crime, Security, and Justice


"The propensity of sex offenders toward re-offense makes them some of the most dangerous criminals on the streets today. One in four rapists will commit another violent crime within three years. These realities require that we maintain a vigorous and vigilant tracking and accountability program. We need to ensure that once we know who these people are, we lock them up and then track them after they are released." - Governor Owens


Governor Bill Owens has always been tough on crime. Even as a legislator, Gov. Owens was already working to strengthen Colorado's child abuse laws and watching out for the victims of crime.


Today, he continues to protect innocent Coloradans from harm. The crime rate has gone down, law enforcement officers have more tools at their disposal, and Colorado's children are safer as a result of tight registration and tracking systems to keep tabs on sex offenders.


And long before Sept. 11, 2001, Gov. Owens signed into law legislation to prepare Colorado for the potential of biological attacks or epidemics.


Colorado's Office of Preparedness, Security and Fire Safety is directed by Mike Beasley, who maintains communication between all agencies at all levels of government that may have a role to play in keeping Colorado safe from threats.


To improve Coloradans' security & safety, Gov. Owens:


• Signed legislation to waive the statute of limitations on sexual assault cases when the crime has been reported and DNA evidence has been taken.

• Signed legislation that posts photographs of two-time sexual offenders, and those who fail to register as sex offenders, on the Internet.

• Issued an Executive Order creating the Governor's Task Force on Sex Offender Registration to strengthen existing registration and develop a uniform, statewide sex offender database.

• Signed legislation to take DNA samples of all convicted felons in Colorado.

• Issued an Executive Order creating the Office of Preparedness, Security and Fire Safety to plan for and prevent terrorist attacks in Colorado.

• Initiated and signed legislation making the impersonation of a police officer a class-six felony and the unauthorized use of red and blue lights a class-one misdemeanor. This law was a response to the death of Lacy Miller, a young college student from Fort Collins who was murdered when she pulled her car over for a man impersonating a police officer.

• Initiated and signed legislation adding the crime of "promotion of obscenity to a minor" to the list of crimes requiring sex-offender registration.

• Signed legislation strengthening parole-eligibility requirements by decreasing the disparity between the time sentenced and the time served by individuals convicted of violent crimes.

• Supported the implementation of faith-based programs at the Department of Corrections.

• Initiated and signed legislation that establishes a process for international extradition of state fugitives, prevents early release of fugitives, and suspends the statute of limitation on escape for persons of unsound mind.

To improve the way Colorado's courts dispense justice, Gov. Owens:

• Appointed 100 appellate and trial court judges throughout Colorado.

• Initiated and signed legislation that created 24 additional District Court Judges in 10 fast-growing judicial districts.

• Fulfilled his promise to appoint tough prosecutors to the bench with the expectation that victims of a crime, when before the court, will receive consideration on par to that of the offenders.

• Appointed a high number of reputable Hispanic judges for which Governor Owens received recognition by the Colorado Hispanic Bar Association and both The Rocky Mountain News and The Denver Post.

• Required the Executive branch administrative law judges to follow the judicial code of ethics and provided additional judicial training for all judges.

• Required Executive agencies to adopt measures to increase the coordination and professionalism of the administrative law judges.

• Supported 500 participants in the Colorado Statewide Parents Coalition Conference held in Breckenridge. Over 200 certificates were presented to participants in the Los Padres and Las Madres Training Programs, which offer classes to enhance parenting skills for Hispanics.

• Established the Governor's Task Force on Civil Justice Reform to evaluate Colorado's civil-justice system and make recommendations for a more efficient system.

• Received praise from the Colorado Women's Bar Association for a "solid record" of appointing women to the bench.

• Worked consistently to improve the quality of the state administrative justice system. Supported and signed legislation requiring judges at the Division of Administrative Hearings to comply with the Colorado Code of Judicial Conduct – the same professional standards applicable to county, district and appellate judges. Issued an Executive Order directing all administrative-law judges outside of DOAH to follow the Code of Judicial Conduct, and required the establishment of appropriate standards of conduct for hearing officers and other executive-branch adjudicatory officials

OWENS STATEMENT ON RAMSEY CASE


DENVER - Like many of you, I have been waiting for the outcome of the

investigation of the JonBenet Ramsey homicide. After a three-year investigation and a lengthy probe by the grand jury, the proceedings in Boulder have now concluded.


While I am not presently in a position to comment on the work of this grand

jury, I do know one fact: a little girl was brutally murdered in Boulder,

Colorado and the killer or killers remain free today.


As Governor, I have the power to appoint a special prosecutor. I am reviewing this option and will make a decision shortly.

DENVER - Governor Bill Owens today at a news conference named a team of experts to advise him on whether he should appoint a special prosecutor in the JonBenet Ramsey murder case. The team plans to meet with Ramsey prosecutors, investigators and others and advise the Governor on a possible special prosecutor appointment.

STATEMENT BY GOVERNOR BILL OWENS ON THE JONBENET RAMSEY MURDER CASE


For the past 34 months, the killers of JonBenet Ramsey have escaped justice.


Earlier this month, a Boulder grand jury looking into the case dissolved as

District Attorney Alex Hunter announced he would not seek any indictments at this time. Mr. Hunter also stressed that the Ramsey investigation would continue. Against this backdrop, I have faced a very difficult decision as

Governor: Whether I should appoint a special prosecutor to take over the Ramsey case.


This is not a decision I take lightly. Law enforcement is chiefly a local

governmental function in our State. Only rarely does a Governor take away a

criminal case from a District Attorney. Yet there is precedent for a Governor to appoint a special prosecutor who goes on to win a conviction, as Governor Roy Romer did a dozen years ago in a child abuse case.


In other instances - including the 1981 case of serial murderer Angelo Buono,

the "Hillside Strangler" of Los Angeles - special prosecutors have gained

convictions where District Attorneys have previously refused to file charges.


Given the unique facts and history of the JonBenet Ramsey case, many Coloradans - and indeed, many citizens from across America - have urged me to intervene in this case.


To help me weigh these competing considerations, I asked a team of seven legal experts - including experienced prosecutors from both political parties, the Attorney General of Colorado, my own Chief Legal Counsel, and the former Chief Justice of the Colorado Supreme Court - to help me review the law and the evidence in this case. My decision reflects their advice, as well as conversations I have had with many other people connected with this case.


But let me stress that this decision is mine and mine alone. In approaching the Ramsey case, one question has guided me: Will my appointment of a special prosecutor at this stage of the investigation help bring the killers of JonBenet to justice? Or will my appointment of a special prosecutor at this stage of the case make it harder to win a conviction?


Ladies and gentlemen, any unsolved crime of violence tears at the fabric of our society, none more so than the murder of a child. This particular case presents a special threat to the public's respect for our criminal justice system. The killers in this case made some serious mistakes, but they are also very smart.


They have stonewalled effectively and covered their tracks well. And the legal burden that the prosecution must satisfy- proving guilt "beyond a reasonable doubt" - is a difficult standard to meet in this case at this time. Add to this the fact that from the very first day, the Ramsey tragedy has been subjected to an almost unprecedented amount of media coverage.


In the face of this media blitz, the initial handling of the Ramsey case

certainly failed to inspire public confidence. As someone who was watching the case from the outside, what I sensed back then I now know to be true:


The conduct of the Ramsey investigation at that time was far from perfect. We may never know if any of those initial mistakes were serious enough to affect the outcome of this case. Yet there can be little doubt that the Ramsey case will be harder to prove in court because of the way it was handled during those early months.


As I have said, these initial problems threatened to damage the effort to bring JonBenet's killers to justice. Fortunately, District Attorney Hunter changed course dramatically last year. He recruited three highly respected prosecutors from outside the Boulder District Attorney's Office - Michael Kane, Mitch Morrissey and Bruce Levin - to advise him on the case. This move was far more than symbolic. It reformed and, yes, redeemed the investigation. Far from mere advisors, the team of Kane, Morrissey and Levin took charge of the Ramsey case in a way that gave hope to their fellow prosecutors and police alike.


In the months since Alex Hunter recruited them, Mike Kane, Mitch Morrissey and Bruce Levin have effectively served as "special prosecutors" in this case. Both they and District Attorney Hunter have assured me they will continue on the case.


The grand jury phase of the investigation is of course completed. But let me

emphasize that a grand jury is just one of the many tools that has been and will be used to gather evidence in this case. Under Colorado law, the prosecution may bring charges at any time - without the need for a grand jury indictment. During my own review of the Ramsey case, I have learned that substantial new evidence - including evidence that did not originate in the grand jury proceedings - is presently being analyzed and will continue to be analyzed by the prosecution team.


I will not comment on the nature of that evidence, either now or in the future.


I will say this: The right people are now working the Ramsey case, and they are working together as a team. And based on the evidence available to me, they are now targeting the right murder suspects.

For these reasons - and with the unanimous support of my legal advisory team - I have decided not to appoint a special prosecutor at this time. Moving forward, I will continue to support the ongoing investigation. Should circumstances change, I will reassess the need for a special prosecutor at that time.


Finally, to the killers of JonBenet Ramsey, let me say this: You only think you have gotten away with murder. There is strong evidence to suggest who you are. I believe that the investigators are moving closer to proving their case. They will keep pursuing you. And I am confident that each day brings us closer to the day when you will reap what you have sown.

So in a short 13 days, from October 14, 1999 to October 27, 1999, this WunderKind Governor and his stellar task force supposedly reviewed ALL the law and MOUNTAINS of evidence in the Ramsey case for one purpose only: to appoint a special prosecutor so as to move the case to prosecution. I think we've all witnessed government convened task forces take years to sift through lesser cases than this. Yet, they did it in 13 short days and came to the conclusion that the case was in competent hands, i.e., Alex Hunter, Mary Keenan, Michael Kane, Mitch Morrissey and Bruce Levin, whom Owens now claims are all "warm and fuzzy" with the BPD, so should remain there because they were also dedicated to continuing development of the case. Only 2 weeks after all these brilliant prosecutors were at each others' throats in GJ proceedings AND the press! Interesting how the "kiss and make up" process works so quickly in Boulder.


So what happened in those 13 days that made Gov. Owens and his task force turn tail and run? Three strikes, of course, and you're OUT!


I. Ramseys hire attorney for the damned


Within days of the book announcement, the Ramseys were again in the news when it was revealed that they had hired L. Lin Wood, a prominent Atlanta libel attorney. Wood, confirming the appointment stated, "John and Patsy Ramsey are probably the most convicted individuals in recent history who have never been charged with any crime. They're not murderers," he says. "I'm sure of that.

II. Ramseys threaten lawsuit against Owens


“By the end of October, the Ramseys' answer to these comments, particularly those made by Governor Owens, was to threaten legal action over what they described as "slanderous remarks." In response Troy Eid, chief counsel for the governor, announced that he believed that Governor Owens was within his rights when he suggested that the Ramseys "quit hiding behind their attorneys" and cooperate with investigators looking for their daughter's killer "no matter where that trail may lead.”


Eid, who was also a member of the special advisory task force that worked with Owens to decide whether to appoint a special prosecutor to the Ramsey case, further stated that the governor was well within his constitutional rights to say what he did having been protected by the First Amendment in his role as a public official.”

III. Ramseys Go On Record


In the midst of threatening legal action and attempting to counter adverse public opinion, John and Patsy Ramsey made the somewhat untimely announcement that they had signed a book deal with a Nashville-based company that specializes in religious books. In a prepared statement, the Ramseys stated that they had decided that it was time to write the book, to be titled The Death of Innocence, so they could fully explain their side of the story and make the world aware of their innocence and their faith in God. John Ramsey told a news conference, "We have patiently waited for the justice process to evolve in the matter of our daughter's death. We have remained silent while baseless and slanderous accusations about our family were made by the frenzied media. The time is appropriate to recount our experiences in this tragedy."

 Tying Up Loose Threads

So, being pressured by multi-million dollar litigation that would probably have been an utter smear campaign, Owens made his announcement that a special prosecutor would not be appointed, even though a dream team of prosecutors had achieved the once-impossible harmony with the BPD. So what happened to all those prosecutors when Owens abandoned them like he did with JonBenet?


In early Spring, 2000, Alex Hunter announced that he would not run for re-election that Fall and, he didn't. What he did do was provide the Ramseys and Lin Wood, in an incredible breach of professional ethics, an affidavit exhonerating Burke Ramsey in the Miles case while handing over the entire Ramsey case file to Lou Smit before he left office with his blessings to take it and run.


Bruce Levin went back to the Adams County District Attorney’s Office where he remains today.


Mitch Morrissey, deputy DA for Denver County, went back to Denver after Owens’ decision, ran in the DA’s race in 2001 and was elected, where he remains today.


Trip DeMuth ran against Mary Keenan in the DA elections and lost, then went into private practice with Ramsey defense lawyer Mike Bynum.


Steve Louth also went into private practice in Boulder.


Pete Hofstrom remains at the Boulder District Attorney’s Office as Mary Keenan's deputy.


Bill Wise, assistant DA, left the BDA to retire in 2001. He no longer has active membership in either the Boulder County or Colorado State Bar Associations.


Shortly after Keenan's election in 2000, Lin Wood threatened her and the City of Boulder with a libel suit, so Keenan et al's "warm and fuzzy" fun with the BPD abruptly ended. She took custody of the case from the BPD, immediately re-hired Lou Smit, then hired Tom Bennett and met in between with Ollie Grey and John St. Augustin. In December, 2002, it became official via a Boulder Press Release that the BPD would no longer have custody or investigative powers over the case (let us remember that it was BPD who officially demanded a special prosecutor and GJ convention back in 1998).


The real hero of the group, Michael Kane, went back to PA from whence he came to resume his professional responsibilities there, although made a stunning but brief comeback in August, 2000 along with Bruce Levin to attempt further police interviews with both Ramseys in Atlanta. Lin Wood, a civil attorney, tagged along for representation and disrupted especially PR's questioning session so badly with highly offensive remarks and accusations against Kane that they all walked out and held press conferences, never to reunite again.


From October 13, 1999 to October 31, 2001, the flurry of lawsuits spawned by Lin Wood's greed and the Ramseys' obsession to clear their names entertained most of us with utter righteous outrage.


But the actual murder case, under Mary Keenan's tight watch, gasped what we all thought was it's last breath, to be buried under Lou Smit's ever-morphing intruder theories while Lin Wood and the Ramseys ran Judge Carnes' severely stunted opinion up every flagpole they could find in America as "proof" of Ramsey innocence.


Until that bright day in Spring, 2004, when FFJ took its petition to Gov. Owens clearly documenting that the material changes in the case and its evidence, as he demanded in his October 27, 1999 press release, mandated a special prosecutor. FFJ even followed it up with a profound legal argument based in a long time CO law, the Pease case, further evidencing that the acts of Lou Smit, as a DA's investigator, and Mary Keenan herself, were so biased and prejudicial throughout civil suits and case inactivity as to greatly substantiate removal of the case from Keenan to a special prosecutor to do what Gov. Owens stated on October 13, 1999 HE wanted-to move the case toward prosecution. There is extremely persuasive new evidence further damning the Ramseys, who have always remained the ONLY suspects under the umbrella of suspicion in the case.


Gov. Owens has utterly failed in every way to address the public's outcry for justice for JonBenet Ramsey while touting himself as a literal deity in CO. He will remain in office until the Fall of 2007, another 3 years, and fully intends to keep this case swept under his office rug where the nasties can't sue, bite, sting or otherwise ruin his deific image.


What is a murdered 6 year old to do against an army of self-aggrandizing, self-indulgent adults????

So Gov Owens knew who they targeting - who was it?


JC, if you click on the link above regarding the Ramseys' threats of suit against Owens, you will find an article that explains that Gov. Owens, in that very crucial time in which he was setting up a task force to appoint a special prosecutor, made public statements that the Ramseys, and specifically John, were, and remain BTW, the ONLY suspects in the case. It was this public comment that provoked JR to challenge Owens to a sit down to discuss the case. Owens of course appropriately declined the invite, which infuriated JR enough to publicly threaten suit.


Later today, I intend to start a new thread of posts of the City of Boulder press releases, not all because there's a bottomless pit of them, but the last released while BPD still had custody of the case. Those releases will reveal that the BPD investigated hundreds of leads, including all brought by the Ramsey investigators, and spent millions of dollars working this case, to come to only one conclusion-the Ramseys are good for it.


Interestingly, at the time Owens publicly announced that the prosecution dream team was the right hands for the case and their Ramsey targets appropriate for investigation, Keenan et al (the new "dream team") has done nothing to further investigate the Ramseys but has focused what little investigation it has done on one after another of Lou Smit's intruder theories. That is, until Tracey's crockumentary compromising the innocent Mr. Gigax. Thanks to Tricia, we know officially that Bennett has not taken that stinky bait. Perhaps they are finally getting wise to Smit's crap.


The "new evidence" that Owens demanded in his last case press release in order to appoint a special prosecutor, which he publicly announced he has the power to do as governor, not only involves new case evidence not considered by the GJ but a new yet inert dream team with volumes of additional new evidence regarding the fitness of Mary Keenan to continue handling the case.


Seeing all of these well documented events laid out in a timeline such as this makes it clear that all of the case activity since October 1999, and official reaction in it, has been spawned by nothing other than Lin Wood's brazen, abusive threats of litigation against anyone and everyone who even breathes the name JonBenet Ramsey. That most run in fear of such a powerless freak at the expense of a murdered child is, to me, incredibly disgusting.


I wanted to create this thread to archive this documentation, and official commentary, for posterity and future reference. Thanks to all for receiving it so well!
