GVS "On the Record" Update:


Family of KS heading to court. Panel to review Savios' lawsuit. Petition to reopen estate to pursue wrongful death suit.


Panel: Bernie Grimm, Ted Williams, Jim Hammer, Michael Cardoza, and Jeanine Pirro


BG: DP can plead the 5th.


TW: DP does not give up his 5th amendment right when he walks in that civil courtroom. His attorney has to ask for the case to be stayed until the criminal case has been resolved.


JH: The judge could stay it indefinitely.


JP: You cannot take away 5th amendment rights just because an incriminating question is couched in a civil trial.


MC: They are not going to make anything on this suit.


JH: You're wrong on this one Mike. The standard of proof is a preponderance of the evidence and they have enough now.


GVS: I talked to JB today and DP brought this up today. Their theory is that Savios believe they will win in a civil court with the wrongful death, however JB told me the statute of limitations is two years for wrongful death in Illinois. However, when does the statute begin to run? Is it when it is determined to be a murder?


(Lots of cross-talk) And from what you are saying OJ had to take the stand in his civil lawsuit because his criminal trial was already over, but in DP's case the criminal case has not been brought yet and he has not even been charged.


TW: It is not about what Baden says, it is about what the state says.


MC: The civil jury, if it goes to trial will give an emotional verdict because they don't like him, not because he is guilty.


GVS: OK, to summarize DP still has a 5th amendment privilege unless and until he is proven to be guilty in a criminal court.
