Terry Lynn Daniel was found NOT GUILTY of Roberta's murder October 26, 2000

Need Photo of Roberta HERE -- "The slaying occurred Jan. 2, 1988. It was after 11 p.m. when [Terry] Daniel called for an ambulance. He said he had arrived home from work to discover a grisly scene.

His wife of three years, Roberta, 33, was dead. She had been beaten and stabbed in their home, her skull crushed, her throat slashed. Her husband's fishing knife had been plunged into her [left side] abdomen. It was later determined she had been stabbed after she was dead.

Emergency medical technicians arrived on icy and snow-covered roads to the Daniel home to find the victim's body on the floor next to a stairwell. The front door was open and a window next to the door was broken. A coffee table and a vase were overturned. A purse with bills sticking out of it was on the kitchen counter and two kitchen drawers were open. A vacuum cleaner was found at her feet, with the hose wrapped around her leg. A firewood log with glass embedded in it was by her head. The only thing missing from the home was a knitting bag containing some "junk jewelry," as Daniel identified it to the OSBI [Oklahoma State Bureau of Investigation]. The bag was found on a county road just north of the house.

The couple didn't have children together, but Terry Daniel has two from a previous marriage, and Roberta Daniel left behind a daughter." -

She said the family had gone on a vacation in July and Terry Daniel almost drowned. Jean Ann Campbell, now of Liberal, Kan. [Seward County], said she asked Roberta "Bobbie" Daniel, 33, to coffee because she thought her friend was not acting like herself."
"Campbell testified that Daniel said she was scared for the first time in her life, but she would not say why. "She said 'I just can't talk to anyone. I can't even talk to my mother,'" Campbell testified. Campbell, a former Watonga restaurant owner, said she questioned the victim about her marriage. The prosecutor implied the defendant was mailing the murder weapon and his bloody clothes. Neither ever were shown in court."
"On the other hand, Beal also was critical of Daniel for not changing his story about his whereabouts prior to the slaying and when he found the body. The prosecutor said Daniel remembered every detail each time he told the story despite finding her body which had to be "the most traumatic experience anyone could have." - "He remembered every little detail because he had rehearsed it over and over again in his mind," Beal said. "Still, he couldn't answer about the post office." -

"[Investigators] believe the body was rolled over 30 minutes to an hour after the slaying, causing them to wonder why more items were not taken if the perpetrator had stayed that long. The only thing missing from the home was a knitting bag containing some "junk jewelry," as Daniel identified it to the OSBI [Oklahoma State Bureau of Investigation]. The bag was found on a county road just north of the house.

Mel Hett, a criminalist for the OSBI, testified in 1994 that the front door lock could not be reached through the broken window. And there were no hairs, blood or fibers to suggest anyone entered through the window, the only point in the house where there was evidence of a forced entry, he said. "It's my opinion that no one has ever been through that window," Hett testified."

"Daniel told investigators he put his coat over his wife's lifeless body. A few glass fragments from the broken window were found on that coat, but Blaine County sheriff's investigators admitted removing the coat from the body and placing it on the floor before securing it as evidence.

There also was testimony at the preliminary hearing that Daniel tried to borrow money, as much as $100,000, from two friends in the weeks before his wife was killed."

-------- "Crieg Rittenhouse, a Harper County assistant district attorney, said Thursday he is offering Blaine County prosecutors 200 pages of evidence which he says supports his allegation. Rittenhouse announced his findings last week during a probate hearing in Blaine County District Court held to appoint a new administrator for the estate of Roberta Daniel. Rittenhouse said he was asked last year [1993] by Roberta Daniel's mother to look into her daughter's murder. The mother, Janice Miller, had served as administrator of Roberta Daniel's estate and was concerned about her former son-in-law having access to a $500,000 life insurance policy that was part of her daughter's estate, Rittenhouse said. Miller died earlier this year, and last week's hearing was held to name a new administrator. Rittenhouse testified against Terry Daniel being named administrator. George Burnett, an assistant Blaine County district attorney, dismissed Rittenhouse's findings."

"Box even points the finger at Donald Wayne Robinett, a friend of the Daniel, as the killer. Robinett was at the Daniels' home on the day of the slaying to retrieve videotapes. Box said Robinett went into the house and talked to the defendant on the telephone. Robinett's fingerprints were found on the telephone in the kitchen."
"Robinett, now of Midland, Texas, denied that he and the victim were involved romantically. Box accused Robinett of changing his story and blamed investigators for not testing blood samples and investigating Robinett's muddy boot prints and pickup tracks. David Sauls, the Oklahoma State Bureau of Investigation's case agent, said Robinett was eliminated partly as a suspect because Terry Daniel first said he saw his wife alive after Robinett's visit."

"[Mel Hett, a criminalist for the OSBI] Hett and State Medical Examiner Dr. Fred Jordan said they agree that hairs were found on the victim's hands. Jordan testified that he sent the OSBI eight hairs on her left hand. Hett said he only received three. Box wants to know what happened. Hett said the hairs he received belonged to the victim's daughter, Brooke Shephard, and animals, probably cats. Small bloodstains by the grandfather clock and in the shower also belonged to animals."
"Terry Daniel's blood was never identified at the scene. There was testimony that with the severity of the victim's injuries, blood would have gotten on her killer. No bloody clothes thought to be the killer's ever were found."
