SEARCH WARRANT

TO ALL PEACE OFFICERS OF THE STATE OF ILLINOIS:

On this day, Tuesday, December 4th, 2007, Complainant-Affiant Special Agent Patrick Callaghan of the Illinois State Police has signed and sworn to a complaint for search warrant before me. Upon examination of the written complaint, I find that said complaint on its face states facts sufficient to show probable cause for the issuance of a search and seizure warrant, and I therefore command that the following vehicles which have been utilized in the commission of the offenses of First Degree Murder (720 ILCS 5/9-1(a)(1)) or Concealment of a Homicidal Death (720 ILCS 5/9-3.1(a)) be seized, searched, forensically analyzed, and retained pending possible forfeture:

A. A 2005 Dark blue GMC Denali SUV with Illinois plate 7343709, with VIN# 1GKFK66U95J113419.

B. A 2002 Purple Pontiac Grand Prix with Illinois plate 1592942, with VIN# 1G2WP12K22F226507.

be searched and that the following described instruments, articles, and things which have been used in the commission of, or which constitute evidence of the offense of First Degree Murder (720 ILCS 5/9-1(a)(1)) or Concealment of a Homicidal Death (720 ILCS 5/9-3.1(a)) be seized, searched and forensically analyzed and retained:

A. Any and all objects, leavings or scrapings which contain or have traces of any of the following on them: blue plastic, lead weights, plastic shavings, plastic scuff marks, circular impressions or carpet indentations, and any other indication of the carrying, placing, movement or collision of a plastic or barrel-like object or large storage container.

B. Any and all trace materials on the outside or inside of the vehicles including dirt, gravel, soil, dust, and any other accretive material which might be tested and compared to materials from a particular location to determine a vehicle's presence at the location.

C. Any and all objects which appear to contain or have any of the following on them: blood, hairs, fingernails, bodily fluids, body tissue, DNA, fingerprints, fingernail scrapings, palm prints, saliva, urine, feces, or other biological material which may be evidence of the offense of First Degree Murder.

D. Any and all instruments which may have been utilized as a weapon or restraint, including but not limited to firearms, ammunition, knives, rope, carpet, and rugs.

E. Any and all papers within either vehicle, including but not limited to gasoline or vehicle maintenance receipts, insurance information, vehicle manuals, and other paper items within either vehicle.

F. Any and all computers as defined in 720 ILCS 5/16D-2, including but not limited to in-dash GPS navigation systems.

G. Any and all objects with chemical traces relating to pool chemicals or any chemical which might be utilized to either retard, mask or accelerate the deterioration or decomposition of a human body.

FORENSIC ANALYSIS AND RETURN OF SEARCH WARRANT: This seizure and search warrant shall include authority for long term scientific analysis and the chemical, trace, or other scientific testing and search of any items seized for relevant evidence as outlined in this seizure and search warrant.

This seizure and search warrant shall be considered formally returned within a reasonable time period by listing all physcial items seized pursuant to the warrant, but items seized pursuant thereto will be retained until all available means of testing are exhausted, or until such time as other items of evidence are available for comparison to the items seized and retained, or until the evidentiary value of said items has been determined at evidentiary hearing to be non-existant and no forfeiture proceeding has been filed.

Full search warrant return including the results of all computer forensic and scientific analysis contemplates a reasonable time period in light of the fact that a GPS navigation computer system contains data in a format that is not easily obtained or searched. It also comtemplates that specialized scientific and forensic testing can take long periods of time both to arrange and complete.

USE OF UNSWORN PERSONNEL: Forensic analysis of any seized computer equipment pursuant to this search warrant may be conducted by employees of law enforcement agencies who are not sworn law enforcement personnel, but are instead civilian employees, particularly related to the automobile industry.

I further command that a return of any physical items so seized shall be made without unnecessary delay before me or before Judge S. White or before any Court of competent jurisdiction.
